 NHRC Intervenes in Two Worker Death Cases in Uttar Pradesh: A Step Towards Accountability and Justice

Every worker has the right to return home safely. When preventable deaths occur due to negligence, they are not merely industrial accidents—they become violations of the fundamental Right to Life guaranteed under Article 21 of the Constitution of India. In a significant development, the National Human Rights Commission (NHRC) has taken cognizance of two separate complaints concerning the tragic deaths of workers in Banda and Raebareli, Uttar Pradesh, and has directed the respective District Magistrates to submit Action Taken Reports (ATRs) within fifteen days.

This intervention sends a powerful message: human dignity and workers' lives cannot be treated as expendable.

NHRC Recognizes Serious Human Rights Violations

After examining complaints submitted by Lenin Raghuvanshi, the NHRC observed that both cases involve serious allegations of human rights violations resulting in loss of life and apparent inaction by public authorities. The Commission held that the allegations warrant an independent inquiry as they potentially violate the victims' constitutional right to life.

Accordingly, on 27 July 2026, the NHRC directed:

  • The District Magistrate, Banda, to investigate the electrocution death of a young labourer.
  • The District Magistrate, Raebareli, to investigate the death of a municipal worker buried alive during pipeline repair.

Both authorities have been instructed to submit their reports to the Commission within 15 days.

Case One: A Young Labourer Dies After Contact with a High-Tension Power Line

Twenty-three-year-old Kamta Prasad of Tindwari in Banda district lost his life on 3 April 2025 after coming into contact with a high-tension electric line while picking drumstick pods from a roadside tree.

According to the complaint, Kamta Prasad suffered severe burns and died while being transported for medical treatment. He was the eldest among three brothers and the primary breadwinner of his family, leaving behind his wife, young daughter and elderly mother.

The complaint questioned whether adequate safety measures existed around dangerous electrical infrastructure and sought accountability for any negligence that contributed to the tragedy.

Recognizing the seriousness of these allegations, the NHRC has ordered the District Magistrate, Banda, to conduct a detailed inquiry and submit an Action Taken Report.

Case Two: Municipal Worker Buried Alive During Pipeline Repair

The second case concerns Chandrabhushan (50), an outsourced municipal employee working in Raebareli.

While repairing a leaking water pipeline in Devanandanpur Mohalla on 1 May 2025, excavated soil reportedly collapsed onto him, trapping him beneath the debris. Despite rescue efforts, he was declared dead at the district hospital.

The complaint alleged that proper excavation safety protocols were either absent or inadequately implemented and called for:

  • an impartial investigation,
  • accountability for negligence,
  • compensation to the bereaved family, and
  • rehabilitation measures for the dependents.

The NHRC agreed that the allegations raise important human rights concerns and directed the District Magistrate, Raebareli, to investigate the matter and report back within fifteen days.

More Than Individual Tragedies

Although the incidents occurred in different districts under different circumstances, they reveal a common and disturbing reality.

Both victims belonged to economically vulnerable families.

Both deaths appear to have occurred while carrying out work in hazardous environments.

Both families suddenly lost their principal source of income.

Both cases raise serious questions about whether preventable safety failures and administrative negligence contributed to the deaths.

These are precisely the kinds of cases where the State bears a heightened responsibility to protect life and ensure accountability.

Why NHRC's Intervention Matters

The NHRC's decision is important for several reasons.

It acknowledges that workplace deaths resulting from negligence are not merely administrative matters but can amount to human rights violations.

It places responsibility on district administrations to independently examine the facts rather than allowing incidents to disappear after brief media attention.

It also reinforces the principle that every death caused by possible official negligence deserves transparency, accountability and justice.

Most importantly, it gives hope to affected families that their voices will not remain unheard.

Justice Must Go Beyond Compensation

Financial assistance is necessary, but compensation alone cannot substitute accountability.

Justice requires:

  • A fair and independent investigation.
  • Identification of negligence wherever it exists.
  • Fixing institutional responsibility.
  • Adequate compensation.
  • Long-term rehabilitation of affected families.
  • Stronger occupational safety measures to prevent future tragedies.

Every preventable death should become an opportunity to improve public safety systems—not just another statistic.

A Call for Safer Workplaces

India's constitutional promise of dignity extends to every worker, whether employed by the government, a municipality, or a private contractor.

No family should lose a loved one because safety standards were ignored.

No worker should risk death simply for earning a livelihood.

The NHRC's intervention in these two cases is a welcome step toward strengthening accountability. The forthcoming Action Taken Reports from Banda and Raebareli will be closely watched, not only by the victims' families but also by everyone committed to protecting human rights and ensuring safe working conditions.

Every worker deserves safety. Every family deserves justice. Every preventable death demands accountability.

A complaint dated 13.05.2025 has been received from Lenin Raghuvanshi R/o Varanasi, U.P. online (email id: pvchr.adv@gmail.com) in the Commission containing that:

The complainant alleges a tragic incident reported by Amar Ujala on April 3, 2025, concerning the death of a laborer, Kamta Prasad (23), in Banda, UP, who came in contact with a high-tension electric line while picking pods from a roadside tree. Despite being rushed for treatment, he succumbed to injuries on the way to the hospital. Kamta was the sole breadwinner of his family and left behind a grieving wife, daughter, and elderly parents.

Upon perusal of complaint, this Commission is of the considered view that the complainant has leveled serious allegations of human right violations resulting in loss of life and inaction by public authorities, thereby violating victim’s Fundamental Right to Life under Article 21.

Accordingly, the Registry is directed to send copy of the complaint to District Magistrate, Banda, U.P. to make an inquiry and submit the report expeditiously within a period of 15 days to this Commission. 

 
2.      Accordingly, I am forwarding herewith a copy of the complaint/ intimation as an attachment for taking appropriate action in the matter as per the directions of the Commission. A complaint dated 24.05.2025 has been received from Lenin Raghuvanshi R/o Varanasi, U.P. online (email id: pvchr.adv@gmail.com) in the Commission containing that:

The complainant highlights the tragic death of Chandrabhushan (50), an outsourced municipal employee, who was buried under excavated soil while repairing a pipeline leakage in Devanandpur, Raebareli. Despite efforts to rescue him, he was declared dead at the district hospital, leading to public outrage. Nagar Palika President assured financial aid of Rs. 5 lakh to the victim’s family and promised his son a job in the Nagar Palika. The complainant urges the commission to conduct an impartial investigation into the negligence, ensure justice for the victim, and guarantee compensation and rehabilitation for his family.

Upon perusal of complaint, this Commission is of the considered view that the complainant has leveled serious allegations of human right violations resulting in loss of life and inaction by public authorities, thereby violating victim’s Fundamental Right to Life under Article 21.

Accordingly, the Registry is directed to send copy of the complaint to District Magistrate, Rai Bareli, U.P. to make an inquiry and submit the report expeditiously within a period of 15 days to this Commission.
