Subject: Follow-up regarding non-submission of the District Magistrate’s Report on Microfinance Violations in Case No. 21090/24/45/2024
Hon’ble Chairperson,
I respectfully submit this follow-up representation regarding NHRC Case No. 21090/24/45/2024, related to my complaint concerning the death of Shri Shailesh Bharti, a young man from the Musahar community of Kushinagar who died under suspicious circumstances on 17 September 2024 in the context of microfinance debt-related distress.
I express sincere appreciation for the Commission’s order dated 4 December 2025, directing the District Magistrate, Kushinagar, to release monetary relief to the victim’s family under the SC/ST (Prevention of Atrocities) Rules, 2016, and to file compliance within six weeks.
However, I wish to bring to the Commission’s urgent attention that a critical component of compliance remains incomplete:
The District Magistrate has not yet submitted the mandatory report on microfinance companies and their coercive lending practices, as required by NHRC’s direction dated 20 November 2024.
The Commission had specifically instructed the DM to provide a detailed survey covering:
Microfinance companies operating in the district,
Loan disbursement methods,
Interest-rate structures,
Loan recovery practices, including coercion and harassment,
Any corrective or regulatory action taken by the district administration.
This report is integral for understanding the structural exploitation that contributed to repeated tragedies in Kushinagar, including the death of Shri Shailesh Bharti. The NHRC’s intervention itself was prompted by investigative reporting, particularly the detailed news story published in The Wire, available at the link below:
The Wire Report:The absence of the DM’s microfinance report severely hinders a comprehensive assessment of the human-rights violations arising from predatory microfinance practices, which have caused distress and fatalities among marginalized communities, including the Musahar community.
In light of the above, I respectfully request the Hon’ble Commission to:
Issue a fresh directive to the District Magistrate, Kushinagar, to immediately submit the pending microfinance survey report in compliance with NHRC Case No. 21090/24/45/2024.
Specify a clear timeline for compliance and ensure accountability for continued delay.
Consider further action to address systemic exploitation by microfinance institutions in Kushinagar and to prevent recurrence of such human-rights violations.
