NHRC Seeks Magisterial Inquiry Report in Custodial Death Case from Gonda, Uttar Pradesh


The National Human Rights Commission (NHRC) has taken cognizance of a complaint filed by Lenin Raghuvanshi, human rights defender and founder of the People’s Vigilance Committee on Human Rights (PVCHR), regarding the alleged custodial death of Devnarayan Yadav (22) in Nawabganj, Gonda district, Uttar Pradesh.

According to the complaint (Diary No. 15696/IN/2022), Devnarayan Yadav was allegedly subjected to brutal beating by police personnel, leading to his death on 14 September 2022. Following the incident, an FIR No. 369/22 under Sections 147 and 302 of the IPC was registered at Police Station Nawabganj on 15 September 2022.

The NHRC, through its communication dated 3 October 2025 (Case No. 30196/24/33/2022-AD), has directed the District Magistrate of Gonda to submit the Magisterial Inquiry Report within eight weeks, noting that the report has not yet been received despite earlier reminders. The Commission also observed that the police have filed a final report citing lack of evidence, which necessitates further scrutiny through the magisterial inquiry.

The complaint filed by Lenin Raghuvanshi urged the NHRC to ensure:

  • Registration of a murder case against the accused officials.

  • Compensation and justice for the deceased’s family.

  • Accountability of the law enforcement personnel involved.

The NHRC’s latest directive emphasizes the importance of transparency and due process in custodial death investigations. Such cases highlight the urgent need for institutional reforms to prevent human rights violations in custody and to restore public trust in the justice system.

PVCHR continues to stand with the victim’s family, advocating for truth, justice, and systemic change.

Sir/ Madam,
 
         I am directed to say that the matter was considered by the Commission on 03/10/2025 and the Commission has directed as follows.:
         

The Commission has received a complaint on 27-09-2022 from Mr. Lenin Radhuvanshi, Coordinator, R/o A-4/2 Daulatpur, Dist- Varanasi (UP)   regarding death of Devnarayan Yadav, Age 22 years on 14-09-2022 due to cruel beating by the police. He requested to register a murder case against the accused and give compensation to the deceased family. In the matter a case FIR No. 369/22 Section 147/302 IPC PS Nawabganj, has been registered on 15-09-2022.

Vide proceeding dated 29.08.2023, the matter has been sent to the Investigation Division for analysis of the reports/records received from the authorities concerned and the Investigation Division after analysis has found as under:-

“…Despite efforts, the pending report i.e Magisterial Inquiry Report and status of the Final Report of case FIR No. 369/22 u/s 147/ 302 IPC of PS Nawabganj submitted before the concerned court are   not received from the concerned authorities. In view of the above, the Hon'ble Commission may kindly be recommended to direct the Registry to call for the pending reports for further analysis of the case file…”

Pursuant to the direction of the Commission, the Addl. Superintendent of Police/Nodal Officer, Gonda, submitted report dated 14.08.2025 along with enquiry report of Circle Officer, Tarabganj. It is submitted that final report has been filed in FIR No. 369/22 u/s 147/ 302 IPC of PS Nawabganj.

The Commission has considered the material placed on record. The police report revealed that due to lack of evidence, final report has been filed in FIR No. 369/22 u/s 147/ 302 IPC of PS Nawabganj.

Further, the Commission has not received any response on the magisterial inquiry report, which was pending before the court of CJM, Gonda.

Therefore, let direction be issued to the District Magistrate, Gonda, Uttar Pradesh, to send a copy of magisterial inquiry report, within eight weeks.

 
2.     It is therefore, requested that the additional/ complete report as directed by the Commission in the matter be sent latest by 08/12/2025, for futher consideration by the Commission.
