NCW Upholds Maternity Rights of Ms. Sangeeta Prajapati Against Sunbeam Women’s College, Varanasi

On 7 October 2025, the National Commission for Women (NCW) conducted a virtual hearing in the case of Ms. Sangeeta Prajapati vs. Sunbeam Women’s College, Varanasi, regarding alleged denial of maternity benefits. The hearing was presided over by Hon’ble Member Ms. Archana Majumdar.

Ms. Prajapati shared that she had been terminated by the college management while on maternity leave, and one month’s salary was withheld as security. The People’s Vigilance Committee on Human Rights (PVCHR) provided advisory support, guiding her on her rights under the Maternity Benefit Act, 1961, without intervening directly.

College authorities argued that the Act did not apply to self-financed institutions. However, the Commission clarified that legal precedents confirm the Act applies to all educational institutions, whether government-aided or self-financed.

Outcome:
The NCW directed the college to provide the complainant with full maternity benefits within seven days, reaffirming that denying maternity rights violates both constitutional protections and statutory law. The Commission also cited multiple Supreme Court judgments supporting the enforcement of these rights.

Quote:
"Every woman has the right to dignity and security at work, especially during maternity. Denying such rights is not just unlawful—it is unjust." — PVCHR

This case emphasizes the need for strict compliance with maternity rights laws in private educational institutions. PVCHR remains committed to providing legal guidance and human rights advocacy to women facing workplace discrimination, ensuring that women’s dignity at work is upheld.
