NCPCR Takes Cognizance of Complaint on Physical Assault of a 4.5-Year-Old Student by Private School Teacher in Varanasi

The National Commission for Protection of Child Rights (NCPCR), Government of India, has taken serious cognizance of a complaint filed by Dr. Lenin Raghuvanshi, Founder-Convener of the People's Vigilance Committee on Human Rights (PVCHR), concerning the physical injury inflicted upon a 4.5-year-old student by a teacher at a private school in Varanasi, Uttar Pradesh.

In its official Notice No. UP-EBN-85920/2025-26/NCPCR/RTE issued under Section 13 of the CPCR Act, 2005, the NCPCR has directed the District Magistrate, Varanasi, to conduct an immediate inquiry into the matter and submit a detailed action report, along with relevant documents, within seven days.

The Commission emphasized that such incidents constitute a grave violation of child rights and contravene several legal provisions, including the Right to Education Act, 2009, the Juvenile Justice (Care and Protection of Children) Act, 2015, and the Protection of Children from Sexual Offences (POCSO) Act, 2012 where applicable. The NCPCR also referred to its Manual on Safety and Security of Children in Schools (2021), highlighting the responsibility of educational institutions to ensure a safe and nurturing environment for children.

According to the complaint lodged by Dr. Raghuvanshi, the young child suffered physical injury at the hands of a teacher, an act that not only violated the child’s dignity but also raised questions about the accountability of the school administration and its adherence to safety protocols. The NCPCR has further directed that necessary police action be taken under Section 75 of the JJ Act, 2015, and Section 323 of the Indian Penal Code (IPC), which pertains to voluntary causing of hurt.

The complaint (ID: EB/EDU/2025/85920) was officially registered on September 1, 2025, and accepted by the Commission after review. The NCPCR’s Education Division, led by Shri Rahul Singh, has communicated the directive to the District Magistrate, Varanasi, with copies sent to the Additional Deputy Commissioner of Police (Varanasi) and the complainant (PVCHR).

PVCHR strongly welcomes the NCPCR’s swift action and reiterates its commitment to protecting children from all forms of violence and ensuring their right to education in a safe environment. The organization continues to advocate for zero tolerance towards corporal punishment and institutional accountability in schools.
